  1. General Provisions

1.1. These Terms and Conditions of Sale of the shop.hocus.lt online store (hereinafter referred to as the “Terms”) establish the rights, obligations, and responsibilities of the Buyer and the Seller when purchasing goods from the Hocus Online Store.

1.2. The Seller – 4Cars, UAB, legal entity code 305915670, registered office address Laisvės Ave. 3, LT-04215 Vilnius, Lithuania, email address info@hocus.lt.

1.3. By placing an order in the Online Store, the Buyer confirms that they have read these Terms and agree to comply with them.

1.4. The Seller has the right to amend or supplement the Terms. Each purchase shall be subject to the version of the Terms that was in force at the time the order was placed.

1.5. Where the Buyer is a consumer, the consumer rights and guarantees established by the laws of the Republic of Lithuania shall apply.

  1. Conclusion of the Purchase and Sale Agreement

2.1. The purchase and sale agreement between the Buyer and the Seller shall be deemed concluded when the Buyer creates and submits an order in the Online Store and, where applicable, makes payment using the selected payment method.

2.2. Once the order has been submitted, an order confirmation shall be sent to the email address provided by the Buyer.

2.3. The Buyer is responsible for the accuracy and correctness of the information provided when placing the order.

  1. Rights of the Seller

3.1. In the event of significant circumstances, the Seller has the right to temporarily restrict or suspend the operation of the Online Store. In such a case, the Seller shall ensure the fulfilment of all orders properly submitted and accepted before the suspension or refund the amounts paid for unfulfilled orders.

3.2. If the Buyer attempts to compromise the operation, stability, or security of the Online Store or otherwise violates these Terms or applicable laws, the Seller has the right to restrict the Buyer’s access to the Online Store.

3.3. If an incorrect product price, stock level, or other material information is displayed in the Online Store due to an obvious technical or system error, the Seller has the right to contact the Buyer and offer to amend or cancel the order. If payment has already been made for a cancelled order, the amount paid shall be refunded to the Buyer.

  1. Obligations of the Seller

4.1. The Seller undertakes to provide the Buyer with access to the services of the Online Store under the conditions set out in these Terms.

4.2. The Seller undertakes to deliver the goods ordered by the Buyer or prepare them for collection using the method selected by the Buyer and in accordance with the conditions specified when placing the order.

4.3. If the Seller is unable to deliver an ordered product due to unforeseen circumstances, the Buyer shall be informed accordingly. The Seller may offer an equivalent or alternative product. If the Buyer refuses the offer, the amount paid for the undelivered product shall be refunded.

4.4. Where a consumer lawfully exercises the right to withdraw from a distance purchase and sale agreement, the Seller shall refund all amounts received from the consumer, including standard delivery costs, no later than 14 calendar days from the date on which the Seller was informed of the decision to withdraw from the agreement. The Seller shall not be required to reimburse any additional costs incurred because the Buyer selected a delivery method that was more expensive than the least expensive standard delivery method offered by the Seller.

4.5. The Seller has the right to withhold the refund until the returned product has been received or the Buyer provides evidence that the product has been sent to the Seller, whichever occurs first.

4.6. The refund shall be made using the same payment method used for the original transaction unless otherwise expressly agreed with the Buyer.

  1. Rights of the Buyer

5.1. The Buyer has the right to purchase goods from the Online Store in accordance with these Terms and the laws of the Republic of Lithuania.

5.2. A Buyer who is considered a consumer under applicable law has the right to withdraw from a distance agreement for the purchase and sale of goods within 14 calendar days from the date of receiving the goods without giving any reason, except in cases provided for by law.

5.3. To exercise the right of withdrawal, the Buyer must clearly inform the Seller of their decision within the specified period.

  1. Obligations of the Buyer

6.1. The Buyer must pay for the ordered goods and accept them in accordance with the procedure set out in these Terms.

6.2. The Buyer undertakes to provide accurate and correct information necessary to fulfil the order and deliver the goods.

6.3. Upon receiving the shipment, the Buyer is advised to inspect the condition of the shipment and the goods. If any damage to the packaging or goods is identified, the Buyer is advised to document it and inform the Seller as soon as possible.

6.4. By using the Online Store and placing an order, the Buyer confirms that they agree to these Terms and undertake to comply with them.

6.5. The Buyer shall be liable for any reduction in the value of the product resulting from handling beyond what was necessary to establish its nature, characteristics, and functionality.

  1. Product Prices

7.1. Product prices in the Online Store are stated in euros and include all applicable taxes, including VAT.

7.2. The final order amount, including any applicable delivery charges, shall be presented to the Buyer before the order is confirmed.

7.3. The Seller has the right to change product prices. However, price changes shall not apply to orders that have already been properly submitted and confirmed, except in cases of obvious technical errors.

  1. Ordering and Payment

8.1. The Buyer selects the desired goods in the Online Store and adds them to the shopping cart.

8.2. When placing an order, the Buyer shall provide the information required to fulfil the order, including their first name, surname, telephone number, email address, delivery or collection information, and any other information necessary to fulfil the order.

8.3. Before submitting the order, the Buyer shall have the opportunity to review the selected goods, their quantities and prices, delivery details, and other order information.

8.4. The Buyer may pay for the goods using the payment methods available at the Online Store checkout.

8.5. The specific payment methods available at the relevant time shall be displayed to the Buyer during checkout.

  1. Delivery and Collection of Goods

9.1. When ordering goods for delivery, the Buyer must provide accurate information required for delivery.

9.2. The available delivery and/or collection methods, their prices, and their terms shall be presented to the Buyer in the Online Store and when placing the order.

9.3. The delivery times shall be specified in the Online Store, during checkout, or in the order confirmation. If no specific delivery time is indicated, the goods shall be delivered within the period established by law.

9.4. The Seller shall not be liable for delays in delivery caused by circumstances beyond the Seller’s control. However, in such cases, the Seller shall cooperate with the Buyer to resolve the situation.

9.5. The main characteristics and instructions for using the goods are provided on the relevant product page in the Online Store.

9.6. Product images displayed in the Online Store are for illustrative purposes only. The actual colour of the product or its packaging and other visual elements may differ slightly due to the display settings of the device being used, updates to the manufacturer’s packaging, or other objective circumstances, provided that such differences do not affect the product’s essential characteristics.

  1. Returns

10.1. A Buyer who is considered a consumer under applicable law has the right to withdraw from a distance purchase and sale agreement within 14 calendar days from the date of receiving the product without giving any reason, except in cases provided for by law.

10.2. To return a product, the Buyer must inform the Seller by email at info@hocus.lt and provide:

  • the order number;

  • the name of the product being returned;

  • a statement confirming that the Buyer wishes to withdraw from the purchase and sale agreement and return the product.

10.3. After notifying the Seller of the withdrawal, the Buyer must send or hand over the product to the Seller without undue delay and no later than 14 calendar days from the date on which the notice of withdrawal was submitted.

10.4. The returned product must be properly packaged to prevent damage during transportation. Where possible, the Buyer is advised to return the product in its original packaging and with all accessories and components.

10.5. The Buyer has the right to inspect the product only to the extent necessary to establish its nature, characteristics, and functionality. If the product has been used beyond what was necessary for this purpose, the Buyer shall be liable for any resulting reduction in its value.

10.6. When returning a product of satisfactory quality by exercising the right to withdraw from a distance agreement, the direct return costs shall be borne by the Buyer unless the Seller has stated otherwise.

10.7. If the Buyer receives a defective, damaged, or incorrect product, the Seller shall cover the reasonable costs associated with returning it.

10.8. When the Buyer exercises the right of withdrawal, the amount paid for the product and the standard delivery costs shall be refunded. If the Buyer selected a delivery method that was more expensive than the least expensive standard delivery method offered by the Seller, the additional difference in cost shall not be refunded.

10.9. The refund shall be made no later than 14 calendar days from the date on which the Seller was informed of the Buyer’s decision to withdraw from the agreement. The Seller has the right to withhold the refund until the returned product has been received or the Buyer provides evidence confirming that the product has been sent, whichever occurs first.

10.10. The right to withdraw from a distance agreement shall not apply in the cases provided for by the laws of the Republic of Lithuania, including, where applicable:

  • goods made according to the Buyer’s individual specifications or clearly personalised goods;

  • goods with a short shelf life;

  • sealed goods that have been unsealed after delivery and are unsuitable for return due to health protection or hygiene reasons;

  • other cases established by law.

  1. Defective Products and Claims

11.1. If the Buyer believes that a purchased product is defective, does not correspond to the order, or has other faults, the Buyer must contact the Seller by email at info@hocus.lt, provide the order number, describe the issue, and, where possible, attach photographs or other information that may help assess the issue.

11.2. In the case of defective goods, the consumer rights and guarantees established by the laws of the Republic of Lithuania shall apply.

  1. Dispute Resolution

12.1. If any questions or disputes arise concerning goods purchased from the Online Store, the Buyer must first contact the Seller by email at info@hocus.lt.

12.2. The Seller shall review the consumer’s request free of charge and, in the cases provided for by law, provide a detailed and reasoned written response no later than 14 calendar days after receiving the request.

12.3. If a Buyer who is a consumer is not satisfied with the Seller’s response, if the claim is only partially satisfied, or if no response is provided within the specified period, the Buyer has the right to contact the State Consumer Rights Protection Authority (VVTAT) for out-of-court dispute resolution.

  1. Final Provisions

13.1. These Terms and the purchase and sale agreement concluded between the Buyer and the Seller shall be governed by the laws of the Republic of Lithuania.

13.2. If any provision of these Terms becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions.

13.3. These Terms do not restrict and shall not be interpreted as restricting any rights granted to the Buyer under the mandatory consumer protection provisions of the laws of the Republic of Lithuania and the European Union.

13.4. Payments may be made in euros. Payments are processed using the MakeCommerce.lt payment platform.
